Terms of service

These Regulations are effective as of June 6, 2025.

§ 1. General Provisions
 1. These Terms and Conditions define the rules and conditions for the provision of electronic services by SafeLead Solutions, with its registered office in Eindhoven, Spalaan 6, 5628 ZG, the Netherlands, KvK: 95907130, VAT ID: NL005178103B20 (hereinafter referred to as the “Service Provider”).
 2. These Terms apply to services provided via the following internet domains (hereinafter collectively referred to as the “Websites”):
• safe-lead.solutions (Website and Store);
• lsafe-lead.eu (Moodle Platform).
 3. Any natural or legal person using the Websites (hereinafter referred to as the “User” or “Client”) is required to read and comply with these Terms and Conditions.
 4. Matters related to personal data protection are governed by a separate document – the Privacy Policy, compliant with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR), available at the following address: https://safe-lead.solutions/pl/gdpr.html. Acceptance of these Terms and Conditions is equivalent to acknowledging the Privacy Policy.
 5. The Service Provider may be contacted via email at: info@safe-lead.solutions.
 6. The Service Provider ensures the accessibility of its services also for persons with disabilities. Users who are unable to contact us electronically have the right to reach out by phone at: +48 728 719 527. To verify identity and ensure data security, the Service Provider may ask the caller to provide the email address associated with their account or order.
§ 2. Definitions
• Training – an educational service in digital form (online course) offered for purchase in the Store.
• Store – the online store available at safe-lead.solutions through which Clients can purchase Trainings.
• Moodle Platform – the e-learning system available at safe-lead.eu, where purchased Trainings are made available.
• Business Day – any day from Monday to Friday, excluding public holidays in the Netherlands.
§ 3. Purchase of Trainings in the Store
 1. To purchase a Training in the Store, the Client must be at least 18 years old and a citizen of a European Union Member State or an associated country (e.g. Switzerland, Norway).
 2. An order is placed by adding the selected Training to the cart and completing the order form.
 3. Providing personal data in the form is voluntary, but necessary for order fulfillment.
 4. Access to the purchased Training on the Moodle Platform will be granted within 24 hours of the payment being received, this time being counted on Business Days only.
 5. Access credentials for the Moodle Platform (login and temporary password) will be sent to the Client electronically along with the VAT invoice.
 6. If the Client wishes to receive an invoice issued to a company (business entity), they are required to provide the full company name and tax identification number (NIP/VAT ID) during the ordering process or in a separate email message.
 7. If the Training includes a physical certificate, its shipment to an address within the territory of the European Union is free of charge. To this end, the Client must provide the Service Provider with an accurate shipping address upon completion of the Training. Providing the address constitutes consent to share the data (name, surname, address, phone number) with the courier company responsible for delivery.
 8. A VAT invoice for the purchase of the Training is issued by default in electronic form and sent to the email address provided in the order form. If the Client wishes to receive a printed invoice, a paper copy will be included with the certificate shipment (if applicable). The request for a paper version must be submitted by email after the purchase.
 9. Payments in the Store are processed via an external payment service provider – Stripe, Inc. The personal data required to process the payment is provided directly to Stripe, which acts as an independent data controller. Stripe may transfer data outside the European Economic Area, including to the United States, while ensuring an adequate level of protection in accordance with EU law requirements, including the use of standard contractual clauses approved by the European Commission. § 4. Right of Withdrawal from a Distance Contract
 1. A Client who is a consumer has the right to withdraw from the purchase agreement for a Training without providing any reason within 14 days from the date of its conclusion.
 2. LOSS OF THE RIGHT OF WITHDRAWAL: Pursuant to Article 16 point (m) of Directive 2011/83/EU of the European Parliament and of the Council, the right of withdrawal does not apply to contracts for the supply of digital content which is not supplied on a tangible medium.
 3. By placing an order, the Client gives explicit consent for the service to begin (granting access to the Training) before the withdrawal period expires. The Client acknowledges that by logging into the Moodle Platform and gaining access to the training materials, they forfeit their right to withdraw from the contract.
§ 5. Terms of Use of the Moodle Platform (safe-lead.eu)
 1. Access to the Moodle Platform is available at safe-lead.eu.
 2. Upon first login, the system will require the User to change the temporary password and complete their profile with full name and email address. This information is necessary for proper User identification and for the issuance of certificates, if applicable.
 3. The Service Provider informs that User passwords are stored in an encrypted database, in accordance with best security practices for personal data protection.
 4. The Service Provider logs the IP addresses of Users logging into the Moodle Platform for security and abuse monitoring purposes.
 5. The time limit for completing a purchased Training is:
• 60 days for individual Clients (private persons);
• 30 days for Users participating in company-sponsored trainings.
The period is counted from the day access is granted. A free extension of access is possible upon prior contact with the Service Provider.
 6. After completing the training, the User account and related data are stored for a period of 5 years. This is based on the legitimate interests of both the Service Provider and the User, namely the ability to issue a duplicate certificate in the future. The legal basis for processing data after the service is completed is Article 6(1)(c) of the GDPR (legal obligation) and Article 6(1)(f) of the GDPR (legitimate interest of the controller).
 7. It is prohibited to use the Moodle Platform in a manner contrary to the law or these Terms and Conditions, in particular:
• excessively burdening the servers;
• posting content that is unlawful, offensive, or infringes on the rights of third parties;
• attempting to gain unauthorized access to system resources.
§ 6. Intellectual Property
 1. All content, educational materials, graphics, videos, and texts provided within the Trainings on the Moodle Platform are the exclusive intellectual property of the Service Provider and are protected by copyright law.
 2. The User acquires only a license to use the training materials for their own personal use.
 3. The following is strictly prohibited:
• sharing access credentials to the Moodle Platform with third parties;
• copying, reproducing, distributing, selling, or otherwise commercially exploiting the training materials, in whole or in part;
• publicly playing or presenting the content of the Training.
 4. Violation of the provisions concerning intellectual property may result in the immediate suspension of access to services and the initiation of legal action to pursue claims for damages.
§ 7. Complaints Procedure
 1. The User has the right to submit complaints regarding the operation of the Websites and the quality of services provided.
 2. Complaints should be submitted electronically to the following email address: info@safe-lead.solutions.
 3. A properly submitted complaint should include at least the name and surname (or company name), email address, and a detailed description of the issue.
 4. The Service Provider will review the complaint within 14 days of its receipt and inform the User of the outcome.
§ 8. Final Provisions
 1. In matters not regulated by these Terms and Conditions, the relevant provisions of Dutch law shall apply.
 2. Any disputes arising from the execution of agreements concluded on the basis of these Terms and Conditions shall be resolved by the court having jurisdiction over the registered office of the Service Provider.
 3. The Service Provider reserves the right to amend the Terms and Conditions. Users with an active account will be informed of any changes electronically. Amendments shall enter into force on the date specified by the Service Provider, not earlier than 7 days after their announcement.
